ANNUAL MEMBERS MEETING Follow-up on the Proxy Vote

Call to Order
The meeting was called to order at 3:30 P.M. by Ms Carol Wilson, President, Marcus Pointe Homeowners Association (MPHA). Approximately 35 concerned homeowners gathered for the meeting.
Ms Wilson turned the meeting over to Larry Clarke, Association Secretary to provide the results of the proxy vote.
We needed 347 proxies to have an official proxy quorum. We ended up with 364 proxies, of which 16 were deemed not valid for failure to either sign, initial or have your chosen proxy sign to proxy, which means the official validated vote was 348 so the vote is official.
Unfortunately, 174 homeowners chose not to participate in the vote which denied the passage of any item on the proxy. Additionally non-resident owner’s response was less than 2% despite three mailings to them.
Here are the final tallies:
- Allow political signs (currently not allowed by the covenants) 30 days before until 1 day after election – 216 yes votes (Failed)
- Item 2 was applicable only to the annual meeting (allowed voting for covenants amendments from the floor at the annual meeting) - 291 yes votes (Failed)
- Establish a fine committee for covenant enforcement for habitual violators – 254 yes votes (Failed)
- Enforce fence height at 6 feet as currently in the covenants – 320 yes votes (Failed)
- Change the covenant wording to fences may be painted from its current wording fences must be painted. – 323 yes votes (Failed)
- Have the MPHA enforce topography changes that violate adjacent neighbor’s property. 326 yes votes (Failed)
- Add a section to the covenants on hurricane shutters (current covenants do not address hurricane shutters) 276 yes votes (Failed)
- Prohibit shutters remaining in place all hurricane season 261 yes votes. (Failed)
After the proxy results were shared, the Board provided a brief update on where we stand with security and the clay pit. A good and lively discussion ensued with some excellent input from those attending.
- Security – Your Board is still collecting formal proposals before it makes a recommendation. Three proposals have been received to date. All are for roving patrols and are quite expensive.
- Clay Pit – Some dumping is occurring from a Gulf Power site in the clay pit. A consent order has been issued by the Florida Department of Environmental Protection (DEP) requesting permission to enter the site, take soil samples and drill monitoring wells for ground water leeching and any potential contamination. Mr Anthony Green had not signed the order as of last Monday. He is apparently operating the C&D pit on an expired permit. Larry Clarke has started an e-mail group for those who want to receive information on the pit as it becomes available.
